Blank Stare Jurisprudence, Lethargic Law Enforcement, and Blind-eye Journalism: The 2020 Presidential Election

If you had the misfortune to be a long-time San Diego Chargers fan, you know well the sick feeling you got when the Chargers began to sit on a lead in the fourth quarter, and they commenced three and out run plays on offense, along with something called the “prevent defense.” And you knew before it happened: they were going to lose again.

The very same feeling engulfed me on election night, when the vote counts in the key swing states mysteriously stopped updating, and then later, on the morning of November 4th as huge numbers of votes came rolling in for Biden, and suddenly the President’s commanding lead in those swing states was lost. You didn’t want to acknowledge it, but you couldn’t avoid the certainty: something had gone grievously wrong, and your team was going to lose.

It is apparent now, two months later, that massive fraud [1] happened that night, on a scale never before attempted in an American election. The evidence is overwhelming, including: a thousand affidavits [2] signed under penalty of perjury by election observers describing every type of election malfeasance imaginable; video evidence [3] of hidden ballots counted in Georgia without observers present; statistical analyses of wildly improbable vote spikes and vote ratios [4] in Biden’s favor coming late in the morning after those inexplicable voting shutdowns [5] in the key swing states; and computer forensics analyses [6] of Dominion Systems in Antrim County, Michigan, revealing a system which flagged 68% of all votes as having errors. The implications of such a high error level are devastating to the integrity of the election:

A staggering number of votes required adjudication. This was a 2020 issue not seen in previous election cycles still stored on the server. This is caused by intentional errors in the system. The intentional errors lead to bulk adjudication of ballots with no oversight, no transparency or audit trail. Our examination of the server logs indicates that this high error rate was incongruent with patterns from previous years. . . . The systemic errors are intentionally designed to create errors in order to push a high volume of ballots to bulk adjudication. [7]

To make matters even worse, the system adjudication log entries have gone missing:

. . . the computer system shows vote adjudication logs for prior years; but all adjudication log entries for the 2020 election cycle are missing. The adjudication process is the simplest way to manually manipulate votes. The lack of records prevents any form of audit accountability, and their conspicuous absence is extremely suspicious since the files exist for previous years using the same software. Removal of these files violates state law and prevents a meaningful audit . . . [7]

Since Dominion voting systems were used in 28 states [8] during the 2020 election, these anomalies unearthed in one forensic audit in Michigan probably have momentous implications for the entire U. S. election of 2020.

Information about Dominion voting systems which was available before the election should also give pause to anyone concerned about election credibility. A Texas assessment of Dominion Voting Systems listed several reasons supporting non-certification, starting with:

Installation is complex, error prone, and tedious. [9]

Georgia’s implementation of the Dominion system was rushed into service, and the selection of Dominion was based on its low cost, not its quality. It was not the top-ranked vendor in the selection process. [10] The Pennsylvania certification of Dominion [11] is perplexing, granting certification subject to a lengthy series of procedural conditions, most of which were to be accomplished by state and local election personnel. The Pennsylvania certification failed to rigorously assess the system for inherent safeguards against misuse by election operators. For example, the report briefly discusses ballot adjudication, [12] but does not even contemplate the prevention of anomalous mass adjudication such as occurred in Antrim County.

However, this enormous accumulation of evidence of election fraud does not appear to matter to the decision makers in this country. With few exceptions, the courts, the federal and state legislatures and executives, and mainstream and social media have exhibited an attitude which is eloquently and uniformly indifferent. They seem frankly astonished at the fuss put up by the President and his supporters, and could not be bothered to look at the evidence. The President’s legal arguments were not allowed to advance [13] to a point where the evidence could actually be seriously considered, although a few state legislatures, including Arizona, [14] Georgia, [15] Michigan, [16] and Pennsylvania [17]) did conduct hearings to collect such evidence. A Nevada judge’s [18] assessment of election fraud evidence was a useless exercise, since the judge dismissed most of the evidence as “hearsay.” [19]

This casual approach to election sanctity by our leadership should be enlightening for citizens who might previously have naively thought that concepts like justice, honesty, fairness, or the rule of law matter when it comes to elections. They do not. What matters is who won. Not how they won. In Washington D.C. and state capitols across the nation, if your opponent outsmarted you, it is your fault, and nobody else’s. The loss by Republicans in the swing states, because they failed to adequately think ahead and prevent election misconduct, is on them. The courts have proven to be quite literally useless in resolving conflicts in an election scenario. They are slow; they are deliberate; they require painstaking procedures for evidence and argument and deliberation. Asking a court to act urgently on a complex question is an absurdity. A blank stare is the best you might get from a court, and outright rejection [20] is the most likely outcome.

But what about law enforcement or congressional or state government investigations? Consider the mind-numbing words of the Attorney General himself, who stared directly at the torrents of evidence cited above, and serenely stated, “To date, we have not seen fraud on a scale that could have affected a different outcome in the election.” What a brazen statement to make without a thorough examination of the evidence. [21] As with the courts, executive or legislative investigations take time, lots of time. And let us not forget the recent investigative record at the Justice Department, wherein the Durham investigation involving suspected Democrat wrongdoing laboriously proceeds agonizingly slowly producing minimal results, in stark contrast to the Mueller investigation of suspected Republican wrongdoing which cranked out multiple criminal convictions even though it failed to achieve its primary objective, the removal of President Trump from office. No, government investigations are not the solution for correcting fraudulent elections.

And then there is the media, the fourth estate, supposedly the ultimate protector of truth and free expression in the United States. Since you are probably already smirking, I will not further belabor the point (much). But take, for example, the recent admonishment of Alex Azar [22] by Chris Wallace of Fox News, correcting the HHS Secretary for not using the term “President-Elect” for Biden. Mr. Wallace was indignant because Mr. Azar did not acknowledge Biden as President-elect, even though the electors had not yet voted and vigorous election challenges were underway in both the courts and state legislatures. Clearly, Mr. Wallace considers himself and his media cohorts to be the arbiters of U. S. elections. The arrogance is astounding. And so these media manipulators turn a blind eye to the facts, insisting they alone determine what constitutes a “fact,” and censoring information which does not contribute to their support of the progressive Democrat agenda.

An obvious pattern has developed here, visible now across several different swing states. Democrats aggressively planned to take control of the 2020 elections, knowing accountability for their actions taken during the election could only be determined months or years later, or more likely never. Subsequently, Republicans, having failed to think ahead and take action sufficient to forestall Democrat fraud, belatedly attempted hopeless lawsuits. Democrats got away with illegal manipulation of the vote in the key swing states in 2020, and those same Democrats have every prospect of succeeding with the same outrageous activities in forthcoming elections, including the two January runoff elections for the Senate in Georgia, unless Republicans become much more strident in their efforts to protect the election process. Republicans should ask themselves why Florida and Texas, certainly tempting Democrat targets in this last election, were able to avoid the debacles which occurred in Pennsylvania, Arizona, Wisconsin, Michigan, Nevada, and Georgia. Is it a coincidence that in Texas, for example, Dominion Voting Systems were rejected, [23] and the use of mass mail-in ballots was prevented? [24] Daniel Payne, writing at JustTheNews, provides an excellent summary detailing how Texas successfully fought the relaxation of voting requirements, while Georgia “settled with voting activists regarding their demanded changes to the state’s voting codes, electing to end the suits on negotiated terms rather than fighting them to the highest courts possible.” [25]

Although the Democrats cheated by every possible means in the 2020 Presidential election, just as they have before in other elections, they were able to apply methods which amplified the effectiveness of their activities to a new level. The mass use of mail-in ballots [26] coupled with the widespread use of unsupervised ballot drop boxes [27] in the swing states facilitated the manufacture of tens to hundreds of thousands of fraudulent Biden votes, depending on the state. The scheme to manufacture ballots was complemented by the “bulk adjudication” capability resident within Dominion Voting Systems, which allowed votes flagged as errors to be “adjudicated” for Biden. Bulk adjudication, which is nothing more than a flagrant voting security deficiency, should never, ever, have been accepted as a voting system function, because a reliable voting system, one meeting required specifications, would never generate enough errors to justify it. Significant security failings such as this would not be tolerated in any other critical infrastructure, such as our military or financial or electrical power systems. Is not our voting infrastructure just as vitally important as these? The nonchalant attitude toward election integrity exhibited by the use of such a system is emblematic of the careless approach toward elections by swing state officials in general. John Perazzo of FrontPageMag thoroughly documents [28] not only the malpractice and misdeeds which occurred in the contested swing states, but also the pre-election lawsuits by Democrats which created the environment for the collapse of election integrity in 2020.

If they do nothing else, Republicans in each state must fight to banish insecure voting systems and counter the Democrat corruption of the election process, which has been accomplished by means such as the approval of mass mail-in ballots, relaxation of voter identification rules, and ballot harvesting. These efforts should be considered essential components of the campaign strategy for any future Republican candidate.
